The rules in plain words
- Annual leave is earned after each full 12 months with the same employer. Renewing the contract with the same employer does not reset the count.
- Rest days and statutory holidays that fall inside annual leave are not counted as leave days — she gets the extra days.
- Annual leave is paid at her average daily wage.
- The employer decides when the leave is taken, after talking with her, and must tell her at least 14 days before.
- Money instead of leave is only allowed for days above 10 in a year, or when the contract ends.

Common questions
How many days of annual leave does a domestic helper get in Hong Kong?
7 days a year for the first two years with the same employer, then one more day each year, up to 14 days from the ninth year.
Does annual leave include Sundays?
No. A rest day or statutory holiday that falls during annual leave is not counted as a leave day.
What happens to unused annual leave when the contract ends?
It is paid out. Leave not yet taken from completed years, and a pro-rata share for the current year if she has worked at least three months of it, unless she was dismissed for serious misconduct.
Can the employer pay money instead of annual leave?
Only for days above 10 in a leave year, or at the end of the contract. The first 10 days must be taken as leave.
